1. About us

This website, lohaia.com (the “Site”), is operated by Lohaia Limited, a company registered in Hong Kong with its registered office at 6 Tonnochy Road, Wan Chai, Hong Kong SAR, China(“LOHAIA”, “we”, “us”, or “our”). You can reach us at info@lohaia.com.

2. Acceptance of these terms

By browsing the Site or placing an order, you agree to be bound by these Terms of Service and by the policies referenced in them, including our Shipping Policy, Return & Refund Policy, and Privacy Policy. If you do not agree to these terms, please do not use the Site.

3. Eligibility

You must be at least 18 years old, or the age of majority in your place of residence, to place an order. By ordering, you confirm that you meet this requirement or have the consent of a parent or guardian.

4. Products & sizing

We work hard to display our products as accurately as possible. Still, colors may appear slightly different depending on your screen, and minor variations between the product photography and the delivered item can occur. Detailed measurements are available in our size guide; please check them carefully before ordering.

5. Orders & acceptance

Your order is an offer to purchase. The order confirmation email you receive after checkout acknowledges that we received your order; it does not yet constitute acceptance. A contract between you and Lohaia Limited is formed when we dispatch your order. We may refuse or cancel any order prior to dispatch (for example, in cases of suspected fraud, stock unavailability, or pricing errors); if we do, you will receive a full refund of any amount already paid.

6. Prices & payment

All prices are shown in euros (EUR). Depending on your country, import duties or taxes may apply on delivery and are your responsibility (see our Shipping Policy). Payments are processed securely by Shopify and its payment partners; we never see or store your full card details. In the unlikely event a product is listed at an obviously incorrect price due to a technical or clerical error, we may cancel the affected order and refund you in full.

7. Order changes & cancellation

You may request changes to or cancellation of your order within 12 hours of purchase by emailing info@lohaia.com. After 12 hours, your order enters fulfillment and can no longer be changed or cancelled.

8. Shipping & delivery

Shipping times, costs, tracking, and customs are governed by our Shipping Policy. Risk in the products passes to you upon delivery to the address you provided. Delivery estimates are given in good faith and are not guaranteed delivery dates.

9. Returns & refunds

Returns, exchanges, store credit, and refunds are governed by our Return & Refund Policy. For customers in the European Union: in line with Article 16(e) of the EU Consumer Rights Directive, the right of withdrawal does not apply to sealed goods unsuitable for return for hygiene reasons once unsealed, which typically includes swimwear. Nothing in these terms limits your statutory rights in respect of faulty or misdescribed goods.

10. Product care

Our swimwear is made to last when cared for properly. Please follow the care instructions provided with each product (hand wash cold, dry in shade, no tumble drying, no bleach, no ironing, rinse after swimming). We are not responsible for damage caused by improper care, chlorine exposure beyond normal use, or normal wear and tear.

11. Intellectual property

All content on the Site, including the LOHAIA name and logo, product designs, photography, text, and graphics, is owned by or licensed to Lohaia Limited and is protected by intellectual property laws. You may not reproduce, distribute, or use any of it for commercial purposes without our prior written consent.

12. Acceptable use

You agree not to misuse the Site: no unlawful activity, no attempts to breach its security or interfere with its operation, no scraping or bulk data extraction, and no impersonating LOHAIA or other customers.

13. Disclaimers & limitation of liability

The Site is provided “as is” and “as available”. To the fullest extent permitted by law, our total liability to you for any claim arising out of or in connection with an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including for death or personal injury caused by negligence, or for fraud, and nothing affects your statutory rights as a consumer.

14. Privacy

How we collect and use your personal data is described in our Privacy Policy.

15. Severability & entire agreement

If any provision of these terms is found to be unenforceable, the remaining provisions remain in full force. These terms, together with the policies referenced in them, constitute the entire agreement between you and Lohaia Limited regarding your use of the Site and your orders.

16. Governing law & disputes

These terms are governed by the laws of the Hong Kong Special Administrative Region. If you are a consumer, you additionally benefit from any mandatory consumer protection provisions of the law of the country in which you reside, and nothing in this clause deprives you of that protection. We encourage you to contact us first, as most issues are resolved quickly and amicably.

17. Changes to these terms

We may update these terms from time to time. The version published on the Site at the time you place your order applies to that order. The “Last updated” date at the top reflects the latest revision.
